Summary

⇒ Arson is to be regarded as a species of criminal damage.

⇒ Under section 1(3) of the Criminal Damage Act 1971:

  • An offence committed under this section by destroying or damaging property by fire shall be charged as arson.

⇒ The requirements of arson are the same as criminal damage, the only difference being that it must be shown that the damage or destruction was caused by fire.
